It also describes your options regarding our use of your Personal Information, as well as how to access and update it.Under data protection law, the term "Personal Data" refers to all information that relates to an identified or identifiable person. At NutriMaster, we only process Personal Data in accordance with applicable data protection laws. NutriMaster is responsible as the controller for the data processing described in this Policy, unless otherwise stated. The term "controller" under data protection law means the entity that decides what and how to do with the personal data collected.We may update this Policy from time to time by publishing a new version of it.

We process your personal data on the following legal bases:

2. for the purpose of providing you with the Service in accordance with the Terms of the contract between you and NutriMaster, or for the purpose of entering into a contract between you and NutriMaster and at your request (for example, when you register for a NutriMaster account),
3. to comply with NutriMaster's legal obligations, or
4. where processing is necessary to protect our legitimate interests or the legitimate interests of a third party, unless your interests or fundamental rights and freedoms requiring the protection of your Personal Data override these.

Protecting our users' personal information is our top priority. To ensure the security of Personal Information, we have implemented the following measures:

At NutriMaster, we collect and use (process) your Personal Data in different ways.If you are a NutriMaster user, we may process the Personal Data that you provide when you register with NutriMaster, or that you provide when you complete your profile.
This includes, for example, your name, email address, country and city.This Personal Data is processed for the following purposes, and on the following legal bases:
- Account registration for accessing and using the App.
- Support and communication: responding to requests from users.
- Processing payments.
- Non-promotional communication on technical, security and contract-related topics (e.g. fraud alerts, account blocking or contract changes).
- Non-promotional communication regarding product updates, new features as well as motivating users to learn.
- Promotional communication regarding any paid services offers or to provide a promotion codes to encourage the learning.
- Conducting product and satisfaction surveys.
- Advertising of products and services of NutriMaster and its business affiliates.
- Compliance with legal requirements and data retention obligations.

We may process information about your learning behaviour, and learning progress for the following purposes, and on the following legal bases:
a) Deploying the app and adapting our services to your needs and skills;
b) Selection of suitable users for interviews, surveys and campaigns;
c) Compliance with legal requirements and data retention obligations.

We may process pseudonymized information about your behaviour on our application. This includes server log files, IP addresses and user IDs, some of which are assigned by third-party providers.
This Personal Data is processed for the following purposes and on the following legal bases:
a) Research and development in the field of machine learning, artificial intelligence, deep learning (transfer to third parties only after prior anonymization);
b) Ensuring the security, performance, and stability of our services, including protection against cyberattacks;
c) Measuring our reach and analysing user behaviour to optimize our products, increase customer satisfaction and improve error analysis.

We may process feedback and information you provide in surveys. This Personal Data is processed for the following purposes, and on the following legal bases:
a) Optimization of our products, increasing customer satisfaction and improving error analysis;
b) Publication on our Website and other marketing channels for promotional purposes.

‍We may process the data you provide to us in contact forms about yourself, such as your name, email, country and city. This Personal Data is processed for the following purposes and on the following legal bases:
a) Customer acquisition;
b) Support and communication: responding to inquiries.

Pseudonymized information about the device and browser you are using, server log files, your network connection, and your IP address. This Personal Data is processed for the following purposes:
a) Ensuring the security, operability and stability of our services, including defence against cyber-attacks;
b) Integration of third-party content (ratings, videos, questionnaires).

Information about your behaviour in the application. This includes your IP address and user IDs, some of which are assigned by third-party providers. This personal data may be processed for the following purposes:
a) Measuring reach and analysing user behaviour to improve customer satisfaction and analyse errors;
b) Conversion tracking to measure reach and determine commissions for our affiliate partners;
c) Remarketing to attract and retain new customers.

When you visit our social media pages in Facebook, Instagram, TikTok (independently and collectively hereinafter to be referred as “Social Media Provider”), through which we present our company or individual products from our range, certain information about you as a visitor is processed.

The social media providers collect and process event data and send us anonymized statistics and insights for our pages, which help us gain insights into the types of actions people take on our page (so-called “page insights”). These page insights are created based on certain information about people who have visited our site(s).
- Facebook and Instagram: Joint Controller Agreement. Data subject rights can also be asserted against Meta. You can find more information on this in their privacy policy.                  
- TikTok: Joint Controller Agreement. Data subject rights can be asserted with TikTok via this form. TikTok and NutriMaster indicate that the Irish Data Protection Commission is the competent supervisory authority for the processing of personal data. You may lodge a complaint with the Irish Data Protection Commission (see www.dataprotection.ie) or any other supervisory authority.
We process information that you have provided to us via our social media page on the respective social media platform. This information may be the username used, contact details or a message to us.

We do not currently sell or rent Personal Information of our customers to any third parties. If we do engage in such activities in the future, you will have the opportunity to remove yourself from any such lists before you are included by emailing us at admin@nutrimaster.app.      
Please exercise caution when deciding whether to disclose your Personal Information.

You have the following rights in relation to the Personal Information we hold about you, in addition to any other rights required by applicable law:
- Know what personal information we have collected about you.
- Access a copy of the personal information that we hold about you.
- Know what personal information about you we have shared with third parties.
- Opt out of the sharing of your personal information with third parties.
- Object to our processing of your personal information.
- Request that we limit our use of your sensitive personal information to what is necessary to perform the services you requested.
- Not be discriminated against for exercising your data subject rights.
- Request that we delete any personal information we have collected from you.
- Request that we correct any inaccurate personal information about you.
- Export the personal information you have provided to NutriMaster in a format that can be transferred electronically to a third party.
- Withdraw any consent you previously gave us to process your personal information with the future effect after such notice.
- Delete your NutriMaster account by following the instructions in the Service.
- Update or correct your information, as well as exercise certain opt-out rights.
- Request access to or deletion of your personal information by sending an email to admin@nutrimaster.app.
Please note that these rights are not absolute and NutriMaster may refuse requests to exercise data subject rights if there is a legitimate reason, such as if we cannot authenticate your identity, if the request could violate the rights of a third party or applicable law, or if the request could interfere with a NutriMaster service or prevent us from delivering a service you requested.
You may also have the right to make a GDPR complaint to the relevant Supervisory Authority.
Typically, NutriMaster retains your personal information until your account is deleted. However, NutriMaster may retain certain information for longer periods of time if necessary to provide our Services, protect our legitimate interests or those of third parties, comply with legal requirements, resolve or defend us in disputes, investigate abuse or disruption of the Service, or enforce agreements. We may also retain anonymous data indefinitely.
We may use cookies and similar technologies in the provision of the Services. Information about how we use these technologies will be in our cookie banners.
Unless otherwise stated, we only store Personal Data for as long as is necessary to achieve the processing purpose or to fulfil our contractual or legal obligations. Such statutory retention obligations may arise from commercial or tax law regulations.

NutriMaster recognizes the sensitivity of personally identifiable information concerning children and minors and other age-related restrictions prescribed by the relevant Authorities. The Service is only intended for persons 18 and over. If you are under 18 years of age, immediately discontinue use of the Service and leave the Website, App or other accessible courses of NutriMaster. NutriMaster will not knowingly collect, maintain, or disclose any personally identifiable information from a person under 18.
With regard to minors and children under 13 years old, NutriMaster is committed to complying with all applicable laws and regulations regarding children, including the Children’s Online Privacy Protection Act (“COPPA”). If you are a parent or guardian who has discovered that your child under the age of 13 has submitted his or her personally identifiable information without your permission or consent, please immediately inform us at admin@nutrimaster.app. NutriMaster will make reasonable efforts to remove the information from its active list at your request.

In some jurisdictions, the Service may be subject to additional privacy policies or local laws. For users in those jurisdictions, the applicable additional privacy policies and local laws will prevail over this Policy to the extent that they conflict with each other.

The section of this Policy entitled "What personal data do we use?" describes the personal data we collect. The categories of such information are as follows: name, email address, online identifier, Internet Protocol (IP) address or other similar identifiers etc. The purpose of collecting such data is to provide you with our services, to improve our services and to target advertising to you.
As a California consumer, you have the right to ask us to tell you certain information about our collection, use, disclosure, or sale of your personal information. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights, below), and subject to certain limitations that we describe below, we will give you this information. You have the right to ask for any or all of the following:

- the categories of sources from which the personal information is collected;
- our business or commercial purpose for collecting or selling that personal information;

You have the right to ask us to correct any personal information we have about you. You have the right to ask for a copy of personal information that we have collected and maintained about you. You may ask for your information from us up to twice during a 12-month period. We will provide our response in a readily (electronic) format.
We will not discriminate against you for exercising any of your CCPA rights.
